Operation Cannoli Newsletter #67 — Second Appeal Hearing

Hi all,

In my last message, I said that we would hopefully get a verdict soon. We got an update today, but it was not a verdict. We will be having a second hearing in our case. It has been scheduled for June 26, 2024 — 350 days from today. I think that this feels especially rough since I was expecting a verdict not a huge wait. It sounds like this is the normal procedure, not that there is something wrong with our case.

I sent a message to our lawyer this morning to express my disappointment about the timeline and to see if there was any way to request that the hearing be moved up, especially with regard to Levi’s plans for grad school in the Netherlands. I’ve attached his messages as a screenshot. In a nutshell, he says that this process is actually moving along smoothly and at a pretty good pace. He says that it is not wise to ask for the hearing to be moved up. He also seems to say that there’s a chance it could be moved up if their schedule changes. I won’t be holding my breath for that.

I wish I were just writing with good news! Fortunately, our attorney does say that the hearing in June will be the end of the process, and I believe that a positive verdict is all but assured at the next hearing. Unfortunately, it seems like this is the timeline we are stuck with. Please let me know if you have any questions, and I will either address them or message our attorney to have him address them.

I’m looking forward to seeing (and waiting impatiently with) many of you in a couple of weeks.
