Dear Roosevelt Landings Neighbors-
In our continuing saga with submetering.... Judge Moyne has not forgotten us. He's had a set-back resulting from the recent death of his mother.
To bring you up-to-date: L&M requested that Judge Moyne withdraw the TRO (Temporary Restraining Order) that prevents them from submetering our building. They made the claim that they are losing approximately $400,000 per month. This amount is clear evidence of how badly they will overcharge us if their plan gets approved. In reality, they are not losing a plug nickel. They're simply not getting to grossly overcharge us in accordance with their plan.
We are currently paying for electricity. We have done so for all of the 50+ years the building has existed since the electricity bill is currently being paid from our rents. L&M simply wants to hang on to that money, not pay ConEd for it, and charge us separately for our electricity. In the real world, that's called double billing.
Our legal beagle, Bill Salo, responded to L&M's atrocious accounting by pointing out the following:
• The TRO preserves the status quo — tenants continue paying rent that already includes electricity.
• The Landlord is not losing money; they are only being prevented from charging extra.
• The proposed submetering scheme violates PSC rules, including rate caps and cost-offset requirements.
• While asking the Court for relief, the Landlord has simultaneously been pressuring Section 8 tenants with ten-day notices and a new five-page lease rider threatening eviction if tenants do not sign.
• Lifting the TRO now would expose tenants to immediate and irreparable harm.
• The Landlord is not losing money; they are only being prevented from charging extra.
• The proposed submetering scheme violates PSC rules, including rate caps and cost-offset requirements.
• While asking the Court for relief, the Landlord has simultaneously been pressuring Section 8 tenants with ten-day notices and a new five-page lease rider threatening eviction if tenants do not sign.
• Lifting the TRO now would expose tenants to immediate and irreparable harm.
In addition- we absolutely MUST get proof of the dangerously faulty wiring, heaters, and air conditioners in our building. If you have had sparks, smoke, or burning in any electric receptacle, heater or a/c unit, please email me IMMEDIATELY! I can't begin to express how massively important this information is. Don't wait. Your safety and the safety of every tenant in the building depends on your information!
