Dear Tenants and Supporters,
I am writing with a brief update on our Article 78 lawsuit in Albany County challenging the PSC’s approval of submetering.
Today, Justice James R. Farrell dismissed the case. This is disappointing news, but it is not the end of the matter. The dismissal was based on a technical service issue involving the four LLCs that own the affected complexes. In my opinion, the decision was erroneous.
Our next step is to file an appeal and seek a new stay of submetering from the Appellate Division, Third Department. Ever since the case was transferred to Albany County, I understood that this result was possible, and I am prepared to move forward in the higher court.
This is a serious stage of the fight, and we will need everyone’s help. I will send a fuller update next week explaining the next steps and what tenants can do to support this effort.
